1About FORGE

FORGE is an AI-native platform focused primarily on helping creators design, build, test, and develop mobile games.

FORGE is under development. Features may change, contain errors, or be limited during early access.

2Eligibility and Accounts

You must be at least 18 years old and legally able to enter into this agreement.

If you use FORGE for a studio or other organization, you confirm that you have authority to accept these terms and grant the permissions in them on its behalf.

You are responsible for accurate account information, protecting your login details, and activity you authorize through your account. Notify us if you suspect unauthorized access.

We may restrict access where we reasonably believe an account is being misused or these terms have been violated.

3Waitlist and Early Access

Joining the waitlist does not guarantee access to FORGE or access by a specific date.

We may control how and when early access is provided and may change, pause, or discontinue early-access features, subject to any specific agreement with you.

4Acceptable Use

You may not use FORGE to:

• Break any law or regulation.
• Infringe intellectual-property, privacy, confidentiality, or other third-party rights.
• Submit content you lack permission to use or license as described in these terms.
• Create malware, fraudulent software, or harmful content.
• Attack, disrupt, unlawfully scrape, or bypass the security or access controls of the platform.
• Resell platform access without our written permission.

Do not submit unnecessary personal data, sensitive personal data, or third-party confidential information without the necessary authority and lawful arrangements.

We may remove content or restrict accounts that violate these rules.

5Your Projects Training and Showcasing

You retain ownership of the concepts, prompts, code, assets, files, and other content you submit to FORGE. Rights in generated outputs are addressed in Section 6. Together, submitted content and generated outputs are referred to here as Project Content.

You grant Fahy a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, analyze, modify, and create derivative works from Project Content to:

• Provide, maintain, support, and secure FORGE.
• Train, fine-tune, evaluate, develop, and improve AI models, agents, tools, and other technology used in or developed for FORGE.

Training permission applies to both private and published projects, including prompts, code, assets, uploaded files, generated outputs, and project interactions, unless we agree otherwise with you in writing.

We do not use FORGE account-registration details, authentication credentials, or billing records to train or fine-tune AI models. These account records are separate from the Project Content training license and are handled for account administration, security, billing, and other applicable purposes described in the Privacy Policy. Personal data that a user includes within project prompts, files, or other Project Content remains subject to Sections 11, 14, and 15.

We may exercise these permissions through authorized employees, contractors, and service providers acting for these purposes. This license does not transfer ownership of your projects to Fahy. You confirm that you have the rights necessary to grant it. Personal data within Project Content remains subject to the Privacy Policy and applicable law.

For non-personal Project Content lawfully incorporated into training datasets or models, the training license continues after account closure to the extent needed to retain and use those datasets and models. This does not override statutory deletion rights or other legal obligations.

Showcasing published games: Once you publicly release a game created using FORGE, you give Fahy a non-exclusive, worldwide, royalty-free permission to use its publicly available title, branding, screenshots, gameplay footage, and public links to showcase FORGE through websites, social media, presentations, and marketing materials. This permission does not authorize public disclosure of unpublished source code, prompts, or other private project materials. You grant this permission only to the extent you hold or are authorized to grant the relevant rights.

Access to private Project Content is limited to the service, training, security, support, and other lawful purposes described in this document. A private project is not excluded from training merely because it has not been published.

6AI Generated Outputs and Ownership

FORGE may generate code, game logic, text, designs, assets, recommendations, tests, and other outputs using artificial intelligence.

As between you and Fahy, you own the generated outputs to the extent ownership rights exist under applicable law. Fahy assigns to you any rights it holds in those outputs, excluding the pre-existing platform technology and materials described in Section 7.

You may use, modify, export, publish, and commercialize your projects and generated outputs, subject to applicable law and third-party rights and licenses. The training and showcase permissions in Section 5 continue to apply.

Outputs may be incomplete, inaccurate, insecure, or similar to outputs created for others. Some outputs may not qualify for intellectual-property protection.

You are responsible for reviewing, testing, and checking the rights and licenses of outputs before publishing or commercially using them. FORGE does not guarantee that outputs are unique, production-ready, non-infringing, or accepted by an app store or distribution platform.

7Ownership of FORGE

The FORGE platform, branding, interface, systems, templates, documentation, and underlying technology remain owned by or licensed to Fahy.

Using FORGE does not give you ownership of the platform. Where Fahy-owned pre-existing components are incorporated into your generated project, you may use, modify, and distribute those components as part of that project, including commercially. Third-party components remain subject to their own licenses.

8Usage Costs and Payments

Pricing, payment arrangements, included usage, and any applicable subscription, credit, renewal, cancellation, or refund terms are discussed and agreed directly with onboarded studios or users before the relevant paid arrangement begins.

Applicable usage costs may include LLM tokens, virtual machines, cloud hosting, Firebase, and other connected services. We will transparently communicate the charging basis and available usage-cost information through FORGE or the agreed onboarding arrangements. Estimates may differ from final usage-based charges.

Charges billed directly by a third-party provider remain subject to your agreement with that provider. These terms do not themselves authorize undisclosed additional charges.

Mandatory consumer cancellation, refund, and other statutory rights remain unaffected.

9Availability and Liability

FORGE is provided on an “as is” and “as available” basis, to the extent permitted by law and subject to any specific commitments agreed with you.

We do not guarantee uninterrupted access, error-free operation, preservation of all project data, commercial success, or acceptance of games by third-party platforms. You should maintain independent backups of important projects.

To the maximum extent allowed by law, Fahy will not be responsible for indirect or consequential losses, lost profits, lost data, lost opportunities, or losses caused by reliance on generated outputs.

To the maximum extent allowed by law, Fahy's total aggregate liability arising from FORGE or these terms will not exceed the amount you paid Fahy for FORGE during the 12 months preceding the event giving rise to the claim.

These exclusions and limits do not apply to Fahy's fraud or gross negligence, or to rights, liabilities, remedies, or obligations that cannot lawfully be excluded or limited.

19Termination

You may stop using FORGE at any time, subject to payment and other obligations already agreed.

We may suspend or terminate access for breach of these terms, security or legal risks, nonpayment of agreed charges, or misuse. Where reasonably practicable and lawful, we will provide notice and an opportunity to address the issue.

You should export important project data before closing your account. Retention and deletion follow Section 14. Provisions intended to continue after termination, including ownership, applicable training and showcase licenses, accrued payment obligations, and liability terms, continue subject to law.

20Governing Law

These terms are governed by the laws of the Kingdom of Saudi Arabia.

Disputes will be handled by the competent courts in Riyadh, Saudi Arabia, unless mandatory applicable law requires otherwise.

21Changes and Separate Agreements

We may update this document as FORGE develops or legal requirements change. The latest version will be published with an updated date, and we will give notice of material changes through appropriate channels.

New training or other permissions do not apply retroactively to previously submitted content unless validly agreed or otherwise lawfully authorized. We obtain new consent where required.

A specific written agreement with you prevails over conflicting general terms to the extent of that conflict, subject to mandatory law. If any provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
